The Stamp Duty and Stamp Duty Reserve Tax (Amendment) (EU Exit) Regulations 2019

These Regulations amend Parts 3 and 4 of the Finance Act 1986 (c. 41) and the Stamp Duty and Stamp Duty Reserve Tax (Exchange Traded Funds) (Exemption) Regulations 2014 (S.I. 2014/911) to ensure the effective operation of that legislation after the withdrawal of the United Kingdom from the European Union.

The Capital Allowances (Energy-saving Plant and Machinery) (Amendment) Order 2019

This Order amends the Capital Allowances (Energy-saving Plant and Machinery) Order 2018 (S.I. 2018/268) (the “Principal Order”). The Principal Order implemented legislation providing a scheme for 100% first-year allowances to encourage businesses to invest in energy-saving plant and machinery. The Principal Order specifies energy-saving plant and machinery eligible for the scheme by reference to the Energy Technology Criteria List and the Energy Technology Product List issued by the Secretary of State for Business, Energy and Industrial Strategy. These lists have been revised and replaced by new lists issued on 26 February 2019.

The Capital Allowances (Environmentally Beneficial Plant and Machinery) (Amendment) Order 2019

This Order amends the Capital Allowances (Environmentally Beneficial Plant and Machinery) Order 2003 (S.I. 2003/2076) (“the principal Order”). The principal Order implemented legislation to introduce a scheme for 100% first-year allowances to encourage businesses to invest in environmentally beneficial plant and machinery (as defined by section 45H of the Capital Allowances Act 2001 (c. 2)).

The Merchant Shipping (Registration of Ships) (Amendment) (EU Exit) Regulations 2019

These Regulations amend the eligibility rules relating to Part I and Part III of the Register of British Ships, contained within the Merchant Shipping (Registration of Ships) Regulations 1993 (S.I. 1993/3138) (“the Registration Regulations”). The rules relating to Part I are amended by regulation 5, which expands eligibility to Commonwealth citizens, citizens of states listed in a further list (in a new Schedule 6 to the Registration Regulations), and non-United Kingdom citizens who are settled in the United Kingdom. The rules relating to Part III (small ships) are amended by regulation 25 which expands eligibility to non-United Kingdom citizens who are settled in the United Kingdom.

The Democratic People’s Republic of Korea (Sanctions) (EU Exit) Regulations 2019

These Regulations are made under the Sanctions and Anti-Money Laundering Act 2018 (c.13) to establish a sanctions regime in relation to the Democratic People’s Republic of Korea (DPRK) for the purposes of implementing many of the obligations that the United Kingdom has under UN Security Council Resolution 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371(2017), 2375(2017), and 2397 (2017). They also have the purposes of restricting the ability of the DPRK to carry on its nuclear, biological or chemical weapons programmes, other weapons of mass destruction programmes and ballistic missile programmes, to promote the abandonment of those programmes and the decommissioning of the weapons, and to promote peace, security and stability on the Korean peninsula.

The Customs (Enforcement of Intellectual Property Rights) (Amendment) (EU Exit) Regulations 2019

These Regulations make amendments to Regulation (EU) No 608/2013 of the European Parliament and of the Council of 12 June 2013 concerning customs enforcement of intellectual property rights and repealing Council Regulation (EC) No. 1383/2003. That Regulation becomes part of domestic law on exit day by virtue of section 3 of the European Union (Withdrawal) Act 2018 (c. 16) and these Regulations ensure that the former continues to operate effectively without deficiency as part of UK law in the event that the UK leaves the EU without a withdrawal agreement.
