These Regulations are made in exercise of the powers conferred by the European Union (Withdrawal) Act 2018 (c. 16) (in particular under section 8(a), (b) and (d)) in order to address failures of retained direct EU legislation to operate effectively and other deficiencies arising from the withdrawal of the United Kingdom from the European Union.

These Regulations are made under powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular as specified in section 8(2)(c) of that Act) arising from the withdrawal of the United Kingdom from the European Union.

These Regulations are the first ones made under section 70 of the Higher Education and Research Act 2017 (“the Act”). They set out the fees which the Office for Students (“OfS”) may charge institutions for their registration in the register of English higher education providers which is maintained by the OfS under section 3 of the Act.
