The Environment Agency (Teggsnose Reservoir and Langley Bottoms Reservoir) Drought Order 2018

This Order, made on the application of the Environment Agency, makes provision to meet a deficiency in the level of water in the Teggsnose and Langley Bottoms reservoirs, which arises from an exceptional shortage of rain and poses a serious threat to the flora and fauna which are dependent on those waters, including flora and fauna in the River Bollin into which these reservoirs flow. In accordance with section 74(3) of the Water Resources Act 1991, this Order will cease to have effect on 12th March 2019 (within six months of the day on which the Order comes into force).

The Vehicle Drivers (Certificates of Professional Competence) (Amendment) (EU Exit) Regulations 2018

These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(g)) arising from the withdrawal of the United Kingdom from the European Union.

The Copyright and Related Rights (Marrakesh Treaty etc.) (Amendment) Regulations 2018

These Regulations amend both the Copyright, Designs and Patents Act 1988 (the “1988 Act”) and the Copyright and Rights in Database Regulations 1997 (the “1997 Regulations”). Article 5(3)(b) of Directive 2001/29/EC (OJ No L167, 22.06.2001, p.10.) of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights (the “Infosoc Directive”) permits Member States to provide an exception to the copyright and related rights provided under the Infosoc Directive in the case of uses, for the benefit of disabled persons, which are directly related to their disability and of a non-commercial nature. Directive 2017/1564 (OJ No L242, 20.09.2017, p.6.) of the European Parliament and of the Council of 13 September 2017 to approximate the laws of Members States relating to copyright and related rights (“the Directive”) requires Member States to provide exceptions or limitations to copyright and related rights for the benefit of disabled persons who are blind, visually impaired or otherwise print-disabled.

The Pension Protection Fund (Pensionable Service) and Occupational Pension Schemes (Investment and Disclosure) (Amendment and Modification) Regulations 2018

The Board of the Pension Protection Fund (“the Board”) is established by section 107 of the Pensions Act 2004 (c. 35) (“the 2004 Act”) to provide compensation for members of certain occupational pension schemes in the event of the insolvency of the scheme’s sponsoring employer, where the pension scheme is underfunded below a certain level. The compensation payable to individual members is determined in accordance with Schedule 7 to the 2004 Act and regulations made under it, including the Pension Protection Fund (Compensation) Regulations 2005 (S.I. 2005/670) (“the Compensation Regulations”). These Regulations make amendments to the Compensation Regulations to insert provisions modifying the effect of Schedule 7 to the 2004 Act in relation to certain schemes.
