Press release: Secondary ticketing sites pledge overhaul

StubHub, GETMEIN! and Seatwave have formally committed to ensuring better information will be given about tickets being resold through their platforms. This builds on changes they had already made during the course of the Competition and Markets Authority’s (CMA) investigation, and will help people to decide whether buying a ticket is worthwhile, as well as pick the best deal for them.

The sites will make clear:

  • whether there is a risk a customer might be turned away at the door
  • which seat in the venue the customer will get
  • who is selling the ticket, so customers can benefit from enhanced legal rights when buying from a business

To ensure people can easily find this vital information, the 3 platforms will make significant changes to the way they gather and display it. They will make it mandatory for sellers to provide this information when listing a ticket, routinely carry out their own checks on primary ticket sellers’ websites about resale restrictions, and act promptly if event organisers tell them information is missing.

The CMA also raised the same concerns about how information is provided to customers with a fourth platform, viagogo, along with other issues, including a historic failure to comply with a commitment given in 2015. However, this platform has not, currently, agreed to make changes the CMA considers necessary. Therefore, the CMA has notified them it will take action through the courts, unless they promptly commit to satisfactorily addressing its concerns.

Michael Grenfell, the CMA’s Executive Director for Enforcement, said:

Thousands of people use secondary ticketing websites to buy tickets for concerts, theatre and other events. So it’s crucial they are told what they are buying, from whom they are buying it, and whether their ticket might not actually get them into the event.

We welcome the changes already made and new commitments we’ve been given by StubHub, Seatwave and GETMEIN! to improve the information on offer, so that people can better judge whether they’re getting a good deal.

But all secondary ticketing websites must play by the rules and treat their customers fairly if anything goes wrong. We take failure to comply with consumer protection law very seriously.

So far viagogo has failed to address our concerns, and we are determined to ensure they comply with the law. We are prepared to use the full range of our powers to protect customers – including action through the courts.

The CMA’s enforcement action, launched late last year, followed a thorough investigation into the sector which identified concerns that consumers who used StubHub, GETMEIN!, Seatwave and viagogo were not being told:

  • about restrictions on using a resold ticket, that had the potential to lead to a buyer being denied access to an event
  • where exactly in a venue they would be seated
  • the identity of the sellers they are buying from – for example whether the seller was a business and/or connected to an event organiser

As part of this investigation, the CMA also raised a number of other concerns with viagogo, including:

  • a historic failure to fully comply with a formal commitment given to the CMA in 2015 to make its customers aware of the face value of tickets
  • making statements about the availability and popularity of tickets on its website which had the potential to mislead consumers or rush them into making a buying decision
  • problems encountered by its customers in getting their money back under the guarantee
  • businesses advertising tickets for sale on the website that they do not yet own and therefore may not be able to supply

The CMA continues to work closely with partner agencies and enforcers working in this field, including:

  • the Advertising Standards Authority – which recently took action against StubHub, GETMEIN!, Seatwave and viagogo – banning the misleading presentation of pricing information on their websites
  • National Trading Standards (NTS) and Trading Standards Scotland – which are examining the practices of businesses that buy and sell tickets in bulk. In NTS’s case this includes looking at how these businesses acquire tickets

Notes for editors

  1. On 19 December 2016, the CMA opened an investigation into suspected breaches of consumer protection law in the online secondary ticketing market.
  2. On 28 November 2017, the CMA announced that it would take enforcement action against a number of secondary ticketing websites suspected of breaking consumer protection law. The CMA raised its concerns with these websites and requested that they take action to address these. Ultimately, only a court can rule that a particular practice infringes the law.
  3. Today’s announcement follows on from this work. The three platforms – StubHub, GETMEIN! and Seatwave – had already made some changes to address concerns during the course of the CMA’s investigation. Today’s announcement details formal undertakings given to build on these changes. These will be made over the coming months.
  4. With regards to the historic undertaking referenced, the CMA announced in March 2015, following an earlier investigation, that viagogo – along with the other 3 main secondary ticketing platforms – had provided an undertaking to improve its practices. This included a commitment to provide information to buyers on the face value of tickets (which may be different from the price the ticket is available for through the secondary ticketing platform).
  5. The CMA plans to produce further materials that will be helpful to the primary market including information about steps that the primary market can take to ensure that key information about access to their events is disclosed, and steps that the primary market can take in order to prevent consumers losing out if they use resale restrictions. The CMA published its initial view on these issues in November 2017 and has received useful feedback from the industry on its proposed approach.
  6. The CMA also plans to publish additional information that will explain, in the light of our recent enforcement action, what all secondary ticket websites – including those not under investigation – need to do to comply with the law.
  7. The CMA is the UK’s primary competition and consumer authority. It is an independent non-ministerial government department with responsibility for carrying out investigations into mergers, markets and the regulated industries and enforcing competition and consumer law.   8. The key pieces of consumer protection legislation relevant to the CMA’s investigation are the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, the Consumer Protection from Unfair Trading Regulations 2008 and the Electronic Commerce (EC Directive) Regulations 2002.

As an enforcer under Part 8 of the Enterprise Act 2002, the CMA cannot impose fines on businesses but it can enforce the above legislation through the courts, and where appropriate, obtain additional measures to improve consumer choice, drive better compliance with the law, or obtain redress for consumers.

Press release: Northern Ireland bites back in the fight against loan sharks

  • For the first time in Northern Ireland a new education project will be created to raise awareness of the dangers of loan sharks and to support vulnerable communities.
  • Over £5.5 million will be spent to fund the fight against loan sharks across the United Kingdom, helping to investigate and prosecute illegal lenders, and support their victims.

Rt Hon Karen Bradley MP, Secretary of State for Northern Ireland, said:

Loan sharks are a blight on society and prey on vulnerable people who struggle to make ends meet and their callous methods will not be tolerated. Northern Ireland is at the forefront of fighting back against their criminal activity with the Consumer Council educating potential victims on the dangers and the PSNI ensuring those responsible will be brought to justice.

More money than ever before is being spent to fund the fight against loan sharks as this Government continues to build a United Kingdom fit for the future.

In Northern Ireland, the Consumer Council will lead its first ever education and awareness campaign to help prevent the most vulnerable from being bitten by loan sharks, and the Police Service of Northern Ireland (PSNI) will get funding for a specialised officer who will lead on illegal lending within the Paramilitary Crime Task Force.

In total, £5.67 million of funding will be provided to Britain’s Illegal Money Lending Teams (IMLT) and bodies in Northern Ireland to tackle illegal lending – a 16% increase compared to the previous year. The money will be used to investigate and prosecute illegal lenders, and to support those who have been the victim of a loan shark.

Since the Illegal Money Lending Team was established in England in 2004, they’ve made over 380 prosecutions, leading to 328 years’ worth of sentences, and have written off over £73 million of illegal debt, helping over 28,000 people to escape the jaws of the loan sharks. Similar teams operate in Scotland and Wales.

John Glen, Economic Secretary to the Treasury said:

These nasty lenders are nothing more than lowlife crooks taking hard-earned cash from the pockets of the most vulnerable. Over 300,000 people are in debt to illegal money lenders in the United Kingdom and they need to know that we’re on their side. That’s why we’re taking the fight to the loan sharks and spending more than ever to support their victims.

Further Information

  • People who lend money without the correct permissions are breaking the law. Often known as loan sharks, these illegal lenders typically charge unfair high rates of interest and use intimidation or violence to go about their business.
  • The Illegal Money Lending Teams in England, Scotland and Wales work alongside the Financial Conduct Authority (FCA) to enforce the consumer credit market, but unlike the FCA they have broader powers to tackle the wider criminality associated with loan sharks, such as violence and blackmail.
  • The Government committed at Autumn Statement 2016 to expand the scheme that uses funds recovered from convicted loan sharks under the Proceeds of Crime Act to incentivise consumers to join credit unions in communities at risk of being targeted by illegal lenders. The more money seized, the more that can be spent.
  • In 2018/19, the England IMLT will spend up to £100,000 in funds seized from loan sharks to incentivise consumers in communities at risk of being targeted by illegal lenders to join and save at a credit union. Four times more funding is available compared to in 2016/17, helping more consumers access alternative sources of credit and avoid the misery caused by loan sharks.
  • In 2016 the Government legislated to introduce a ringfenced FCA levy on consumer credit firms, and since April 2017 this levy has been used by HM Treasury to fund crucial action against illegal lending.

Press release: Government champions innovation in bid to build well-designed homes

  • Ministers to call for closer links between government and industry to deliver well-designed homes.
  • Industry summit to promote quality design to help deliver new homes and fix the broken housing market.

Ministers will today (25 April 2018) call on industry to embrace the latest innovations to make sure we are building the good quality homes that our country needs.

As part of the government’s focus on fixing the broken housing market and its ambition of delivering 300,000 new homes in England by the mid-2020s, it’s essential that the quality and design of new housing is addressed. This can help secure support from communities for new homes, and make sure we have good quality homes that people can feel proud living in and next-door to.

Recent research shows that more than 7 out of 10 people would support new residential development if buildings are well-designed and in keeping with their local area.

Action to boost innovative approaches for well-designed new homes include:

£1 billion investment through the Home Building Fund to develop new, modern approaches to design and construction

To date, 8 projects across 11 local authorities, backed by government funding, will use modern methods of construction such as modular homes to build good quality homes, using the latest techniques, whilst helping to speed up housing delivery.

Learning from other countries like Australia, Norway and Sweden where good design is embedded in decision making

For example, based on an Australian model, the government will urge councils to set their own design quality standards, giving communities the ability to better reflect their own unique character in local planning policy.

Embracing new technologies

For example using Virtual Reality (VR) technology to win the confidence of communities before a single brick is laid. By visualising proposed new housing from the neighbour or homebuyer’s perspective, communities will be able to see how development can visually contribute to the area from an early stage, even before planning permission has been granted.

Housing Secretary Sajid Javid will say:

Our homes are the making of all of us, which is why today’s event on raising the bar on the quality of new homes is so important.

This government is determined to make sure that high quality design is the norm rather than the exception.

Housing Minister Dominic Raab will say:

We are putting high-quality design on the map as never before when it comes to building better homes and stronger communities.

Today’s conference marks an important milestone in that journey.

Industry leaders, including local authority planners, developers and design professionals, attending the Design Quality Conference will share their expertise to ensure how homes look becomes just as important as the number delivered.

Ministers will focus on how developers can use better quality design in order to win over both communities and new generations of first-time buyers, who expect the highest quality homes before parting with their hard-earned deposits.

When things go wrong, the government has also proposed strengthening ways for homebuyers to complain when their home hasn’t been built satisfactorily – with these new measures recently being subject to a consultation.

The event will build on previous government action to ensure new homes are built using quality materials and design methods, as set out in the recently published draft National Planning Policy Framework.

The document, which is currently out to consultation, outlines requirements for design guides and codes to feature prominently in new Local Plans, significant consideration to be given to existing local character as well as setting out the density of developments that meet the needs and expectations of the community.

The conference will also include speakers from the Royal Institute of British Architects, Stephen Lawrence Trust, The Princes Foundation, Historic England and Homes England as well as other experts with experience in delivering excellent build quality for new and existing communities.

  • How to use quality methods and materials to create supportive communities.
  • New approaches that lead to quality design in practice.

National Planning Policy Framework

In the revised National Planning Policy Framework it is made clear that the government is committed to ensuring the planning system can deliver high quality buildings and places.

The document sets out that permission should be refused for a development of poor design that fails to take the opportunities for improving the character and quality of an area and the way it functions. Conversely, where the design of a development accords with clear expectations in local policies, design should not be used by the decision-maker as a valid reason to object to development.

Housing white paper

The housing white paper published in February 2017 also set out the government’s ambition to give communities a stronger voice in the design of new housing, and to drive up the quality and character of new development, building on the success of neighbourhood planning.

Home Building Fund

The £3 billion Home Building Fund provides support for builders using modern methods of construction, custom builders, and new entrants to the market. An additional £1.5 million announced in the Autumn Budget will help small and medium-sized builders who cannot access the finance they need.

Eight projects employing modern methods of construction have been awarded almost £1 billion through the Home Building Fund to date.

Press release: Penny Mordaunt announces UK aid commitment to protect civilians, aid workers and hospitals targeted by the Asad regime

The UK will provide lifesaving emergency medical support and help protect medical facilities and brave humanitarian workers that are being deliberately targeted with bombs and chemical weapons by the Asad regime, the International Development Secretary Penny Mordaunt will say in Brussels today (Wednesday 25 April).

UK aid will help to train thousands of doctors and nurses to deliver trauma care in the most extreme conflict zones and to immediately respond to attacks, including how to remove shrapnel and treat blast injuries, burns and wounds from mortar fire. It will also provide essential medical supplies such as sutures, oxygen, blood and anaesthetics.

UK support aims to keep medical facilities open and we are are providing blast proofing materials and sandbags to reinforce underground medical facilities and limit the damage from attacks.

Ms Mordaunt announced that the UK will provide at least £450 million this year to alleviate the extreme suffering in Syria, as well as providing vital support to millions of Syrian refugees sheltering in neighbouring countries.

With at least 30,000 people currently injured every month in Syria, it is expected that around a quarter of this UK aid support in Syria will be spent on healthcare next year.

Speaking at the Brussels conference on ‘Supporting the Future of Syria and the region’, Ms Mordaunt is expected to say:

It is clear the Syrian Regime and its backers, Russia and Iran, will attempt to block every diplomatic effort to hold the regime accountable for these reprehensible and illegal tactics.

Syria is now one of the most dangerous places on earth for aid workers and medical staff. Medical facilities and schools have been deliberately targeted, aid has been blocked to starve communities into submission, and rape and sexual violence have been deployed as routine weapons of war.

Today’s pledge of UK aid support will help keep medical facilities open in the face of relentless attacks so doctors and nurses can save the lives of innocent Syrians, as well as helping the millions of Syrian refugees sheltering in neighbouring countries. But today can’t only be about pledges of money and we cannot allow anyone to turn their backs on the global rules and standards that keep us all safe.

We’re calling for an immediate ceasefire and safe access so that brave aid workers and medical staff can do their jobs without fear of attack. This year, we must go beyond commitments. We must see concrete actions, which lead to greater protection for civilians and aid workers and work together to put Syria on a path towards peace.

It is estimated that at least 478 health facilities have been attacked or destroyed and at least 830 health workers have been killed in Syria since the conflict began in 2011.

There has been an increase in the number of health facilities in Syria targeted in the first months of 2018, with 36 facilities attacked in February alone.

Last year UK aid supported more than 175 health facilities, with more than 11,000 trained healthcare workers that delivered 2.2 million consultations.

On top of this, UK support has provided specialist training and equipment to respond to chemical weapons attacks, as well as providing personal protective equipment for frontline aid workers and 20,000 ampules of antidote to treat the effects of some chemical agents.

The UK will continue to use our position as a permanent member of the UN Security Council and on the Human Rights Council to support resolutions that seek to protect civilians and humanitarian workers, as well as calling for existing resolutions to be observed by the regime and its backers.

With 5.6 million Syrian refugees sheltering in neighbouring countries, the UK aid commitment announced today will also provide support in Jordan and Lebanon so that Syrian refugees can remain close to home until they are one day able to return safely. On top of this, the UK will provide additional support for refugees in Turkey.

  1. The International Development Secretary has committed to provide at least £450 million for Syria and the region in 2018 and £300 million in 2019. This brings the total amount that the UK has committed in humanitarian funding to the Syria region to £2.71 billion, up from £2.46 billion. The UK’s pledge for 2018 includes £200 million of new money for the crisis, and our pledge for 2019 includes £50 million of new money.
  2. In addition, the International Development Secretary also confirmed that the UK will pay its part of the second round of the EU Facility for Refugees in Turkey (FRIT2).

Press release: Minister for Europe attends Gallipoli Commemorations in Turkey

The Minister paid respects to allied forces who lost their lives over a century ago in the World War One Gallipoli campaign.

Sir Alan attended an International Service of Commemoration where he was invited to deliver a speech of reconciliation and lay a wreath.

He will join other dignitaries from around the world representing New Zealand, Australia and France.

The Minister for Europe Sir Alan Duncan said:

I am honoured to attend the Gallipoli commemorations and pay respects to allied forces who fought in the World War One campaign.

It is also a remarkable testament to the power of reconciliation that a century after Turkey and the UK were on opposite sides, we now stand shoulder to shoulder as NATO allies and trusted friends.

Press release: Queen approves appointment of President of the Family Division

Her Majesty The Queen has been pleased to approve the appointment of The Rt Hon Sir Andrew McFarlane as the President of the Family Division from 28 July 2018. This appointment follows the retirement of Sir James Munby on 27 July 2018.

Sir Andrew McFarlane was called to the Bar in 1977 and took Silk (Queen’s Counsel) in 1998. He was appointed a Recorder in 1995, a Deputy High Court Judge in 2000 and a High Court Judge in the Family Division in 2005.

He co-wrote Children Law and Practice which coincided with the enactment of the Children Act 1989 in 1991, and he has been noted for his speeches and lectures around the country on all aspects of child law.

His expertise resulted in his selection as the only legal member of the Family Justice Review (Norgrove) and as the judicial representative for the current sector-led review financed by the Nuffield. The review is due to report this summer.

Sir Andrew has held or holds leadership posts including Chairman of the Family Law Bar Association, Chairman of the Clergy Discipline Commission and President of the Clergy Disciplines Tribunals. He was Family Division Liaison Judge for the Midland circuit until his appointment as a Lord Justice of Appeal in 2011 where he is the Supervising Lord Justice for Family Cases.

The appointment

The appointment of the President of the Family Division was made by Her Majesty The Queen on the advice of the Prime Minister and the Lord Chancellor following the recommendation of an independent selection panel chaired by Lord Burnett of Maldon, the Lord Chief Justice.

The other panel members were:

  • the President of the Supreme Court
  • Baroness Hale
  • three lay Judicial Appointments Commissioners namely, Professor Lord Kakkar (Chairman of the Judicial Appointments Commission), Dame Valarie Strachan and Mr Andrew Kennon

The President is the Head of the Family Division of the High Court of Justice and may sit as of right in the Court of Appeal, the High Court and the Family Court either alone or as part of a panel. He is also Head of Family Justice, Head of Probate, President of the Court of Protection and chairs both the Family Procedure Rule Committee and Family Justice Council.

The exercise

This selection exercise was run under the relevant sections of the Constitutional Reform Act 2005 as amended by the Crime and Courts Act 2013.

In accordance with section 70 of the Constitutional Reform Act 2005, as amended by the Crime and Courts Act 2013, the panel determined the selection process to be followed. As required by the Crime and Courts Act 2013, the Lord Chancellor was consulted as part of the selection process.

In accordance with s.10 (3) of the Senior Courts Act 1981, the selection exercise was open to all applicants who satisfy the judicial-appointment eligibility condition on a 7-year basis, or are judges of the Supreme Court of the United Kingdom, Court of Appeal, or High Court.

Press release: Tyre-related deaths and injuries preventable say Highways England and Bridgestone

More than 30 people were killed or seriously injured in motorway accidents in 2016 due to illegal or faulty tyres.

But an 18-month study says commuters, commercial drivers and other road users can do a lot more to help reduce accidents through regular checking.

England’s motorways are the safest in the world but we’re determined to reduce the number of people killed and seriously injured on them.

This important research confirms our view that road users must play a bigger role and get into the habit of checking tyre pressures and tread depths and looking out for nails and other debris stuck in tyres before setting out on journeys. These simple checks could save lives.

Unveiled today at the annual Commercial Vehicle Show at Birmingham’s NEC, the research reveals that almost three quarters of tyre failure samples analysed by Bridgestone involved poor inflation or debris penetration issues – problems which could be potentially avoided with better tyre husbandry.

Both Bridgestone and Highways England, the government company for operating, maintaining and improving the country’s motorways and major A roads, are partners in the multi-agency road safety charity Tyresafe. They worked together to carry out the research over 18 months between the beginning of 2016 and last summer.

During the project, staff working for Highways England at depots across the West Midlands provided more than 1,000 pieces of tyre debris from motorways to a technical engineering team from Bridgestone to analyse.

The findings from 1035 tyre segments retrieved from the M1, M6, M40, M5 and M42 revealed:

  • 56% of tyres failed due to road/yard debris penetration
  • 18% failed due to poor inflation
  • 8% failed due to poor vehicle maintenance
  • 1% of tyres failed due to manufacturing defects
  • 1% of tyres failed due to excessive heat
  • 16% of the tyres couldn’t be specified to one particular problem

The tyre debris was taken from cars, vans, commercial vehicles and motorbikes, with under-inflation of tyres a key theme, along with poor vehicle maintenance, both of which accounted for 26% of the entire sample. When considering that 32 people were killed or seriously injured in motorway road traffic accidents in 2016 due to ‘illegal, defective or underinflated tyres’ Bridgestone and Highways England say simple tyre checks save lives.

In addition, the cost to the economy from a 2-hour delay on a busy stretch of motorway following a 2-lane closure stands at £135,360 and a massive £1,488,960 for a 3-lane closure lasting up to four hours .

Some of the samples were particularly alarming, with a temporary ‘space-saver’ spare tyre being run to destruction, while a number of potentially lethal and illegal ‘string’ repairs were also found on car tyres, which are completely unsuitable at any speed, let alone 70mph speeds on motorways.

Bridgestone technical manager Gary Powell, who oversaw the analysis of the debris with field engineer Peter Moulding and the rest of the firm’s technical department, said:

This report has taken a great deal of time and effort, involving a painstaking process of collecting tyre debris over 18 months and analysing it in depth thereafter. In conclusion, some simple tyre checks can save lives, not to mention reduce the risk of a stressful breakdown on a motorway.

With proper vehicle inspection and maintenance programs, many of the failure methods noted should be detectable and preventable. In light of these results, we would also advise that tyre pressure monitoring systems (TPMS) are fitted to vehicles which don’t benefit from this technology already. It will assist with the detection of penetrations and deflations.

Press release: Maintenance work starts on Shrewsbury flood defence

The existing flood defences consist of a flood wall that has a strong concrete core. The work being carried out is replacing the sandstone cladding that covers the main part of the wall, that helps protect homes and businesses from flooding.

Locals will know that the sandstone has recently been showing signs of wear and tear. So, the Environment Agency is pleased to replace the cladding, to make sure the flood wall is well maintained and is in keeping with the surrounding area.

While this work is happening there is no change to the standard of protection offered by the flood defence and the repairs taking place are mainly for aesthetic and public safety purposes. In the event that the demountable flood barriers at Frankwell are required, the repair works will not affect any aspect of the deployment and the flood defence will still continue to perform normally and effectively at times of flood.

The work is expected to take approximately 3 weeks to complete, and throughout the works, access for the public around the work and to the life buoys will be maintained.

We’re pleased to be able to carry out this work. While it is largely cosmetic as no work is needed on the main concrete core of the flood wall, we’re keen to make sure flood defences remain in keeping with the area.

We would like to thank Shropshire Council for arranging the path to be temporarily diverted and for allowing us access to the Theatre Severn car park to store equipment during the work.

The Frankwell flood alleviation scheme reduces the risk of flooding from the River Severn. The scheme consists of a series of permanent flood walls (700m) and demountable slats (155m) along the north bank of the Severn as it flows to the north of Shrewsbury Town Centre.
