Section 145(1) of the Social Services and Well-being (Wales) Act 2014 (anaw 4) (“the 2014 Act”) enables the Welsh Ministers to issue codes on the exercise of social services functions. Section 145(3) of the 2014 Act requires local authorities, when exercising social services functions, to act in accordance with any relevant requirements contained in a code and to have regard to any relevant guidelines contained in the code.

Section 23 of the Criminal Appeal Act 1995 (c. 35) provides that it is an offence for a person who is or has been a member or employee of the Criminal Cases Review Commission (“the Commission”) to disclose information obtained by the Commission in the exercise of their functions, unless the disclosure is the subject of an exception under section 24 of that Act. The same applies to the authorisation by a member of a disclosure made by an employee. One of the exceptions specified in section 24 is where disclosure is made in circumstances in which the disclosure of information is permitted by an order made by the Secretary of State.

Section 105 of the Utilities Act 2000 provides a general restriction on the disclosure of certain information, subject to a number of specified exceptions. This Order amends that provision to allow for disclosure for the purpose of facilitating the performance of any function of the Authority under the Domestic Gas and Electricity (Tariff Cap) Act 2018 (c. 21). The Authority means the Gas and Electricity Markets Authority.

These Regulations amend the Smoke Control Areas (Authorised Fuels) (Wales) Regulations 2019 (S.I. 2019/50 (W. 15)) (“the 2019 Regulations”).

These Regulations implement the obligations of a Member State laid down in Article 3(j) of Directive 2007/36/EC of the European Parliament and of the Council of 11 July 2007 on the exercise of certain rights of shareholders in listed companies (OJ L 184, 14.7.2007, p 17). Article 3j of Directive 2007/36/EC was inserted, together with Chapter 1a and the rest of Chapter 1b, by Article 1(3) of Directive (EU) 2017/828 of the European Parliament and of the Council of 17 May 2017 amending Directive 2007/36/EC as regards the encouragement of long-term shareholder engagement (OJ L 132, 20.5.2017, p. 1).

These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a) to (c), (e), and (g)) arising from the withdrawal of the UK from the European Union.
