These Regulations bring into force on 8th April 2019 customs provisions that enable premises to be approved as transit sheds for imported goods (subject to conditions, and pending a change in terminology to ‘temporary storage facilities’). This is part of the preparations for the United Kingdom exiting the EU.

These Regulations are made in exercise of the powers conferred by the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular section 8(2)(a) and (g)) arising from the withdrawal of the United Kingdom from the European Union.

These are the seventh Commencement Regulations made under the Small, Business, Enterprise and Employment Act 2015 (c. 26) (the “2015 Act”). These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular, the deficiencies under paragraphs (c), (d), and (e) of section 8(2)) arising from the withdrawal of the United Kingdom from the European Union. They are also made under section 2(2) of the European Communities Act 1972 in part to amend domestic legislation.
