This instrument makes a further amendment to the Merchant Shipping (Marine Equipment) Regulations 2016 (as amended by the Merchant Shipping (Marine Equipment) (Amendment etc.) (EU Exit) Regulations 2019). It gives effect to the Agreement dated 14th February 2019 between the United Kingdom of Great Britain and Northern Ireland and the United States of America on the Mutual Recognition of Certificates of Conformity for Marine Equipment (“the Agreement”).

These Regulations make provision, under section 2(2) of the European Communities Act 1972, updating the definition of EEA State in the Pilotage Act 1987 (c. 21) to accord with the definition in the Interpretation Act 1978.

These Regulations are made in exercise of the powers conferred by section 8(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a), (b), (c) and (g)) arising from the withdrawal of the UK from the European Union, and in exercise of powers conferred by section 2(2) of the European Communities Act 1972 (in respect of regulations 3 and 4).
