This Order brings into force, on 1st January 2018, paragraph 2 of Schedule 21 to the Environment Act 1995 (c. 25) for all remaining purposes. That paragraph substitutes section 222 of the Water Resources Act 1991 (c. 57) to provide that the provisions of that Act, including Part 2, bind the Crown.

This Order revokes Orders deemed to be made under section 33 of the Water Resources Act 1991 (c. 57) which were saved following the repeal of that section by section 10(11) of the Water Act 2003 (c. 37). Those Orders provide exemptions from the restrictions on abstraction of water set out in section 24 of that Act.

These Regulations specify enactments for the purposes of section 102(5)(b) of the Water Act 2003 (c. 37). Section 102(5)(b) provides that nothing in those specified enactments prevents the Environment Agency or the Natural Resources Body for Wales (“the appropriate agency”) from granting a licence under Chapter 2 of Part 2 of the Water Resources Act 1991 (c. 57) in respect of abstractions of water described in that section.

These Regulations specify the circumstances in which a police station can be used as a place of safety for an adult, for the purposes of powers in sections 135 and 136 of the Mental Health Act 1983 (that is, powers to remove or take an adult to, or to keep an adult at, a place of safety), as amended by the Policing and Crime Act 2017. Where a police station is used, the Regulations also describe the safeguards and steps to be taken to protect the person detained.
